These Terms & Conditions ("Terms") govern your use of geotekpr.com and of the GeoNET RTK correction service, which GeoTek PR, LLC ("GeoTek PR," "we," "us") offers. By using the website, starting a GeoNET trial, or subscribing to GeoNET, you agree to these Terms. If you accept them for a company, you confirm you have authority to bind that company.

Section A — Website Terms

A1. Use of the website

You may use this website to learn about our products and services and to contact us. You agree not to misuse it, including by attempting unauthorized access, interfering with its operation, scraping it in bulk, or using it to send unlawful or harmful content.

A2. Information on the website

We work to keep product information, specifications and prices accurate. Specifications come from manufacturers and may change without notice. Accuracy figures describe typical performance under good conditions and are not guarantees for any specific project. Prices shown on the site do not include applicable taxes. Except for GeoNET subscriptions, which you can buy online under Section B, a product or price on the website is not an offer to sell. Equipment, software and training sales happen only when we issue a written quote and you accept it.

A3. Intellectual property

The website's content, design, text and graphics, and the GeoTek PR and GeoNET names and logos, belong to GeoTek PR, LLC. You may not copy or reuse them without our written permission. AlphaGEO, Falcon X, 3Dsurvey, WISPR, SkyScout and other product names belong to their respective owners and are used to identify their products.

Links to other sites are provided for convenience. We are not responsible for their content or practices.

Section B — GeoNET Service Terms

B1. The service

GeoNET is a real-time kinematic (RTK) correction service. It delivers GNSS correction data over the internet using the NTRIP protocol to compatible receivers that you provide. The service needs an active internet connection (usually cellular) at your receiver, and a receiver that can send NMEA GGA position messages.

B2. Coverage and accuracy

GeoNET covers 95% of Puerto Rico with precision of 2 cm or better, and the remaining 5% with precision better than 10 cm. Actual results at any given point depend on factors outside our control, including:

• distance to the nearest reference station;
• satellite geometry, sky visibility, multipath, and atmospheric conditions;
• cellular coverage and latency;
• receiver model, antenna, firmware, settings, and correct antenna height;
• the coordinate system, geoid model, and transformations configured on your data collector.

You are responsible for verifying your results against known control appropriate to your project, and for the professional judgment applied to any survey, design or deliverable. GeoNET is a positioning aid. It does not replace the independent checks, procedures, or certification that a licensed professional must apply under the standards that govern their practice.

B3. Reference frame and datum changes

Corrections are referenced to the network's published reference frame. Reference stations may be re-coordinated, and the National Geodetic Survey is transitioning Puerto Rico to new national datums (NSRS2022). These changes can shift coordinates. We will give subscribers advance notice of known changes that affect coordinates, when we receive it from the relevant authority or provider. You are responsible for managing transformations within your projects.

B4. Free trial

• We offer one free trial per person or organization, at our discretion. The trial length is the one shown on the GeoNET page when you request it. No payment method is required.
• Trial credentials stop working at the end of the trial unless you subscribe.
• We may decline, shorten or end a trial in case of misuse.

B5. Plans, prices and payment

• Prices are in U.S. dollars and do not include applicable taxes, including Puerto Rico Sales and Use Tax (IVU), which we add where the law requires.
• Payment is due in advance, through PayPal, ATH Móvil, or another method we accept.
• AlphaGEO plan eligibility: we must verify that the receiver is AlphaGEO equipment, by serial number, before issuing credentials at this rate. If the plan is used with ineligible equipment, we may move the account to the Regular rate.
• We issue or extend credentials within one business day of confirmed payment (or of verification, for the AlphaGEO plan), by email or WhatsApp.
• We may change prices with at least 30 days' notice by email. A change applies to payments made after it takes effect. Prepaid terms keep their price until they end.

B6. Renewal, expiration and refunds

• Plans do not renew automatically. Each monthly or annual plan is prepaid for its term. We do not charge you again unless you choose to pay for a new term.
• Your credentials stop working at the end of the paid term. We send a reminder before your term ends. To continue, pay for a new term; we will reactivate your account with the same username.
• Monthly plans: we do not give refunds for partial months.
• Annual plans: paid in advance for 12 months. They are not refundable once credentials are issued.
• We may refund a payment, at our discretion, if we could not activate the service for reasons on our side.

B7. Your credentials and acceptable use

• Credentials are issued to one subscriber. Each credential may be used by one receiver at a time.
• Do not share, resell, rebroadcast or redistribute credentials or correction data, and do not use them to run a base or caster for third parties, without our written agreement.
• Keep your credentials confidential. You are responsible for activity under your account. Tell us right away if you think they have been compromised, and we will issue new ones.
• We may suspend credentials that show simultaneous use from multiple locations, sharing, or other misuse.

B8. Availability and maintenance

We work to keep GeoNET available around the clock, but we do not guarantee uninterrupted or error-free service. Service may be interrupted by maintenance, equipment or power failures, internet or cellular outages, space weather, natural disasters, or other events outside our control. We will try to announce planned maintenance in advance. Interruptions do not entitle you to a refund, except where we decide to give a credit.

B9. Suspension and termination

We may suspend or end your access if you breach these Terms, or if we must do so to protect the network or other users. If we stop offering GeoNET entirely, we will give active subscribers at least 30 days' notice and refund any prepaid, unused full months.

B10. Referral program

Active GeoNET subscribers may earn free service months by referring new subscribers, under the program rules published at geotekpr.com/geonet/. Referral months have no cash value and cannot be transferred. We may change or end the program with 30 days' notice; months already earned will be honored.

Section C — Equipment, software and training

• Equipment purchases are governed by the written quote or invoice GeoTek PR issues, including its delivery, payment and warranty terms. Manufacturer warranties apply as stated in the quote. Warranty service through GeoTek PR requires proof of purchase and the equipment serial number.
• Software (for example 3Dsurvey, AlphaStudio or SurPro) is licensed by its publisher under the publisher's end-user license agreement. GeoTek PR facilitates licensing, training and integration but is not the licensor.
• Training is governed by the written proposal for each course. A GeoTek PR Certificate of Participation confirms that you took part in a GeoTek PR course. It does not certify competency, and it is not a professional license or a government certification.
• Drone (UAS) operation: buyers are responsible for complying with FAA rules, including remote pilot certification, registration, and airspace authorization.
• Compliance statements: any statement about procurement or regulatory compliance (for example, NDAA or Blue UAS) applies only to the exact product configuration named in the written quote. Buyers are responsible for confirming the requirements of their own projects and contracts.

Section D — General terms

D1. Disclaimer of warranties

Except as expressly stated in a written quote, invoice, or manufacturer warranty, the website and the GeoNET service are provided "as is" and "as available." To the maximum extent allowed by law, GeoTek PR disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

D2. Limitation of liability

To the maximum extent allowed by law:

• GeoTek PR is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, project delays, or re-work costs, arising from the website or the GeoNET service, even if we were told such damages were possible.
• GeoTek PR's total liability for any claim related to the GeoNET service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under Puerto Rico law.

D3. Indemnity

You agree to indemnify GeoTek PR against third-party claims arising from your breach of these Terms, from your misuse of credentials, or from deliverables you produce using the service.

D4. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Puerto Rico and, where applicable, U.S. federal law. Disputes will be resolved exclusively in the courts located in San Juan, Puerto Rico.

D5. Language

These Terms are published in Spanish and English. If the Spanish and English versions conflict, the Spanish version prevails.

D6. Changes to these Terms

We may update these Terms. We will post the new version with a new effective date and notify active GeoNET subscribers by email of material changes at least 30 days before they apply. Continued use after that date means you accept the updated Terms.

D7. Other terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your account without our consent. These Terms, together with any written quote or proposal you accept, are the complete agreement on their subject.
